"We don’t accuse a robber of stealing based on whether or not they felt bad about stealing— they are charged by the simple fact that property was stolen."

It bears pointing out that rape/sexual assault is the only crime where we don't go on simple facts. Not only do we not ask the accused if s/he felt bad about the robbery, we don't put the victim on the stand and ask them how many times they'd been robbed before, how many windows they's left open, how much they'd had to drink before they were victimized etc etc.
